In an effort to assure the most responsible residents possible we require that your rental application be completed in full.  Your information will be verified and a Credit Report run.  We are designated as Crime Free Multi Housing, and as such, parents are reminded that they are responsible, in full, for the actions of their children.  All residents 18 and over must complete the Crime Free Addendum.  You are required to notify the Management, at once, of any changes to occupants.

There is a non-refundable charge in the amount of $25.00 per applicant for the credit report and to verify your information.  This amount is needs to be in a separate check.

At least $500.00 in a separate check, must accompany this application.  Units are leased to the first qualified applicant.  This means if your approval is delayed, and we have another qualified applicant, you will be given the opportunity to take the next available like unit.  Advertising and availability continues until approved.  Approval process begins immediately, and under most circumstances, should be completed within 72 hours of application.  Any portion of the security deposit submitted will be refunded if you do not meet approval, or another applicant is qualified and we cannot provide you with an acceptable like unit.  If you change your mind after you are approved and the unit is taken off the market, your $500.00 fee will not be refunded.   Vacant units may be held for 15 days or until the first of the following month, whichever is sooner, before prorated rent commences.  Occupied units will require a minimum of 5 working days, once the previous tenant has moved out, to ready the unit.  We cannot be responsible for hold over of a previous tenant, nor will we be responsible if the unit has been damaged that requires more than 5 days to ready it for your occupancy.  We will not move a new tenant into a unit that does not meet our standards of readiness.

Once approved, the remaining deposit and first month's rent, and or any portion of the prorated rent, must be paid in advance of move-in.  We require a walk through inspection with the tenant prior to move in, and a certificate of renters insurance.  Prorated rent is figured on a 30 day month.  For example, a unit that rents for $900.00 per month would be $30.00 per day.Utilities must be placed in your effective your possession date of the unit.  You may not move anything in prior to the walk through with the management, payment of security deposit and rent, and utilities are placed in your name.

Units are leased on a 12 month (one full year) basis.  Please read and understand your lease, as there are charges if you do not fulfill the full 12 months.   It is a legal contract and will be enforced.  Tenant right to possession of the rental premises is expressly conditioned on the timely payment of rent.  Failure to pay rent promptly when due is grounds for default and eviction.  We require rent to be paid on or before the first of the month, with late fees beginning on the 1st.   There is an additional deposit required for a small dog or cat, and $150.00 of this is non refundable.  The lease also provides for additional cleaning requirements if there is excessive hair or odor from a pet, candle soot, or smoking in the unit.  We also charge if you do not have the unit clean and in move in condition, there are drink stains on flooring or other damages that cannot be removed.  This includes damages from children or guests.  As tenants, you are responsible for the condition, cleanliness, and or damages to the unit.

Once security deposit is received and you have been approved, please contact the following utilities and have them transferred to your name effective the possession date you are given.  This must be done whether or not the unit is occupied by that date.  Some utilities require a deposit and may need to be made in person.

CRIME FREE LEASE ADDENDUM

In consideration of the execution or renewal of a lease of the dwelling unit identified in the lease, Owner and Resident agree as follows:

    1.  Resident, any members of the resident's household or a guest of other person under the resident's control shall not engage in criminal activity, including drug-related criminal activity , on or near the said premises.  "Drug-related criminal activity " means the illegal manufacture, sale, distribution, use or possession with intent to manufacture, sell, distribute, or use of controlled substance (as defined in Section 102 of the Controlled Substance Act {21 U.S.C. 802}).

    2.  Resident, any member of the resident's household or guest or other person under the resident's control shall not engage in any act intended to facilitate criminal activity, including drug-related criminal activity on or near the said premises.

    3.  Resident or members of the household will not permit the dwelling to be used for, or to facilitate criminal activity, including drug-related criminal activity, regardless of whether in the individual engaging in such activity is a member of the household, or a guest.

    4.  Resident, any member of the resident's household or a guest, or another person under the resident's control shall not engage in the unlawful manufacturing, selling, using, storing, keeping, or giving of a controlled substance or marijuana as defined in SDCL 22-42, at any locations, whether on or near the dwelling unit premises or otherwise.

    5.  Resident, any member of the resident's household or a guest, or another person under the resident's control shall not engage in any illegal activity, inclu7ding prostitution as defined in SDCL 22-23-1, criminal street gang activity as defined in SDCL 22-10-14, threatening, intimidating or stalking as prohibited in SDCL 22-19A, assault as prohibited in SDCL 22-18, or the unlawful discharge of firearms, as determined in SDCL 22-14-7. on or near the dwelling unit premises, or any breach of the lease agreement that otherwise jeopardizes the health, safety and welfare of the landlord, his agent or other tenant or involving imminent or actual serious property damage as defined in SDCL 22-34.

    6.  VIOLATION OF THE ABOVE PROVISIONS SHALL BE A MATERIAL AND IRREPARABLE VIOLATION OF THE LEASE AND GOOD CAUSE FOR IMMEDIATE TERMINATION OF TENANCY.  A single violation of any of the provisions of this added addendum shall be deemed a serious violation and a material and irreparable non-compliance.  It is understood that a single violation shall be good cause for immediate termination of the lease under SDCL 43-32.  Unless otherwise provided by law, proof of violation shall not require criminal conviction, but shall be by substantial evidence of the type reasonably relied upon by property managers in the usual and regular course of business.

    7. In case of conflict between the provisions of this addendum and any other provisions of the lease, the provisions of the addendum shall govern.

    8.  This LEASE ADDENDUM is incorporated into the lease executed or renewed this day between Owner and Resident.
